These Terms govern your access to and use of OneSong, including our website, applications, and services (collectively, the "Service"). By accessing or using the Service, you agree to these Terms. If you do not agree, you must not use the Service.

1. Definitions

  • "You" means the individual or entity using the Service.
  • "Content" means any text, images, audio, prompts, or other materials you submit.
  • "Output" means songs, audio, lyrics, metadata, or other materials generated or delivered by the Service.
  • "Credits" means usage units purchased or granted to create Output.
  • "Order" means a paid transaction for Credits or a specific Output.

2. Eligibility and Account

You must be at least 13 years old (or older if required by your local laws) to use the Service. You are responsible for all activity on your account and for maintaining the confidentiality of your credentials. We may require additional verification to prevent abuse or fraud.

3. Service Description

OneSong provides an automated, AI-assisted music creation service that transforms your Content into Output. Output is generated based on your inputs and system parameters and may vary between uses.

4. License to Your Content

You retain ownership of your Content. By submitting Content, you grant OneSong a worldwide, non-exclusive, royalty-free license to host, process, transmit, and use your Content solely to provide, operate, and improve the Service.

5. Output Rights and Permitted Use

  • You receive a perpetual, non-exclusive, worldwide license to use your Output for personal, non-commercial purposes.
  • Commercial use, public broadcast, or synchronization in monetized content may require a separate license.
  • OneSong does not guarantee that Output is free from third-party rights claims. You are responsible for your use.

6. User Responsibilities

  • You will provide accurate, complete, and lawful Content.
  • You will not submit confidential or highly sensitive personal data.
  • You are responsible for ensuring you have rights to any third-party material you submit.

7. Prohibited Use

You agree not to use the Service to:

  • Generate or distribute unlawful, hateful, harassing, or explicit content.
  • Infringe third-party intellectual property, privacy, or publicity rights.
  • Reverse engineer, scrape, or attempt to extract models, datasets, or system prompts.
  • Interfere with or disrupt the Service, security, or integrity of our systems.

8. Payments, Credits, and Taxes

  • Prices are displayed in supported currencies (INR/USD) and are subject to change without notice.
  • Credits expire only if stated at time of purchase or promotion.
  • You are responsible for any applicable taxes, fees, and currency conversion charges.
  • Orders may be limited or declined to prevent fraud or abuse.

9. Refunds and Cancellations

Refund eligibility is governed by our Refunds & Cancellations policy. Once generation begins, your order is generally non-cancellable due to immediate computing costs.

10. Third-Party Services and Links

The Service may integrate third-party services or links. We are not responsible for their availability, content, or actions. Your use of third-party services is subject to their own terms.

11. Feedback

If you submit feedback or suggestions, you grant OneSong the right to use them without restriction or compensation.

12. Disclaimers

THE SERVICE AND OUTPUT ARE PROVIDED "AS IS" AND "AS AVAILABLE". WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ONESONG SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM.

14. Indemnification

You agree to defend, indemnify, and hold harmless OneSong and its affiliates, officers, employees, and agents from any claims, damages, liabilities, and expenses arising from your use of the Service, your Content, or your violation of these Terms.

15. Suspension and Termination

We may suspend or terminate your access to the Service at any time if you violate these Terms or misuse the Service. Upon termination, your access ends immediately, but licenses granted for Output already delivered will remain subject to these Terms.

16. Dispute Resolution and Class Action Waiver

Before filing a claim, you agree to attempt to resolve disputes informally by contacting us. If not resolved, any claim will be brought exclusively in the courts of Bengaluru, Karnataka. You agree to waive any right to participate in a class or representative action.

17. Force Majeure

We are not liable for delays or failures due to events beyond our reasonable control, including outages, network disruptions, or acts of God.

18. Assignment

You may not assign your rights under these Terms without our consent. We may assign these Terms without restriction.

19. Severability and Entire Agreement

If any provision is found unenforceable, the remaining provisions will remain in effect. These Terms constitute the entire agreement between you and OneSong regarding the Service.

20. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
